Process for the Creation or Abolition of a Legislative Council in a State
Under Article 169 of the Indian Constitution, Parliament has the power to create (create) or abolish (dissolution/abolition) a Legislative Council in a state. This requires the State Legislative Assembly to pass a special resolution by a majority of its total membership and a two-thirds majority of the members present and voting, after which Parliament passes it by ordinary law.
The creation or abolition of a State Legislative Council is governed by Article 169 of the Indian Constitution, vesting ultimate power in Parliament. It requires a special majority resolution from the state's Legislative Assembly, followed by a simple majority act in Parliament. Such action does not constitute a constitutional amendment under Article 368.
