Did you know that till 2018, attempting suicide was a crime in India under Section 309 IPC?
But over the years, landmark cases like P. Rathinam v. Union of India, Gian Kaur v. State of Punjab, and Common Cause v. Union of India completely changed the legal stance.
Today, under the Mental Healthcare Act, 2017 (Section 115), a suicide attempt is treated as a mental health issue and not a crime. But here’s the catch – under the new Bharatiya Nyaya Sanhita, 2023 (Section 226), if someone attempts suicide to obstruct a public servant from doing their duty, it is still considered an offence punishable with jail, fine, or community service.
So the big question is: Should attempt to suicide be treated as a crime or a mental health issue?
