In this video, we discuss an important legal question: Can a private complaint be filed directly in the Session Court?
According to the Supreme Court judgment (Muhammad Saeed vs State, 1984) and Lahore High Court ruling (PLJ 2009 Lahore), a private complaint must first be filed before a Magistrate under Section 190 Cr.P.C. The Magistrate, if satisfied, may then forward it to the Session Court for further proceedings.
