Title of Presentation: Cultural Rights of Constructed Language Users in Twelve Post-Soviet Countries: Possibilities and Challenges
Abstract of Presentation:
This study examines the cultural rights applicable to constructed languages (conlangs), based on the legal frameworks of twelve post-Soviet countries. Even though auxiliary or artistic conlangs are usually not native for anyone and thus unlikely to be requested as languages of education and upbringing, official communication, etc., the most probable scenarios for conlang usage regulated by national legacy are cultural events, mass media and organization naming. This list reflects the aims of these types conlangs, namely, intercultural communication (in case of auxlangs) and recreation (in case of artlangs). The rights of usage of languages designed for intercultural communication (Esperanto, Interlingua, etc.) or cognitive experiments (Lojban, Laadan, Toki Pona, etc.) in education are beyond the scope of this study. The study was performed with the method of legal analysis of language, culture and media acts of the states in question. In case the texts of acts did not provide possibility to make a confident conclusion, the judgement of the regulating agency was requested. The results show that while some of these countries restrict usage of non-national or non-local languages in the cultural area in general, most of them allow their usage irrespective of their genesis. A case of a law targeted specifically against conlangs rather than any natural language along with the motivation from the governmental agency and the possible concequences of conlang usage permission are also discussed.
