In civil litigation, the usual rule is that the unsuccessful party pays the successful party's costs. Often, this is used as a deterrent by a party with a strong case. However, sometimes very well resourced and powerful businesses and organisations will use the threat of litigation to silence critics. These types of claims are known as Strategic Lawsuits Against Public Participation (SLAPPs).
The SRA, which regulates solicitors, is concerned about this type of litigation and has recently issued a notice to warn solicitors against participating in strategic lawsuits against public participation. To find out more, please visit my blog - a link is in the comments below.
