In a landmark ruling, the Supreme Court has upheld the payment of bride price as part of customary marriage. But the justices ruled that bride price is optional should be left to consenting parties to decide. In the lead judgment, Justice Jotham Tumwesigye emphasized that the demand for bride price as a pre-condition for customary marriage is unconstitutional. The highest court in the land also ruled that refunding bride price after separation is unconstitutional. Justice Esther Kisakye Mayambala was the only dissenting Justice in the coram of seven that included Chief Justice Bart Katureebe MIFUMI, a human rights NGO lost the petition in the Constitutional Court and appealed to the Supreme Court.
