2011 me Supreme court ne transfer of property through power of attorney ko nearly invalid declare kar dia tha. Ab yahan dhyaan dene ki zarurat hai ke why “nearly?”

Well, aisa isliye kyunki power of attorney ke through properties abhi bhi sell and buy ho sakti hain. It depends on the understanding of the parties involved. However, it involves several risks.

Sab se pehle toh power of attorney usually unn properties par hoti hai jinki registry nahi hoti, ya jo unregistered colonies me hoti hain. Is kaaran banks loan sanction nahi karte, and buyers and sellers ke liye apne illegitimate money ko legitimate karna aasaan ho jata hai.


Secondly, sellers and buyers, power of attorney document ke liye kisi bhi advocate se consult kar sakte hain and document avail kar sakte hain. It’s not a legal document, jis vajah se iska koi government record nahi hota, and ye primarily mutual trust and understanding par based hoti hai.

For these reasons the Supreme court had to take a stand.
