Do you see TAX deducted on your W-2 for SOCIAL SECURITY and MEDICARE taxes? BE AWARE that as a NON RESIDENT ALIEN in the USA, you are EXEMPT from paying any FICA taxes.

FICA taxes include:
1) Social Security Tax
2) Medicare Tax
If these taxes are DEDUCTED from your W-2, you are eligible to get a refund.
FIRST step is to CONTACT YOUR EMPLOYER, tell them that as a Non Resident Alien, you are exempt from FICA TAXES under INTERNAL REVENUE CODE 3121 (b) (19) and ask for a refund. Some employers refund your money directly to you.
But if they REFUSE to give you a refund, you have to MAIL the forms 843 and 8316 to the IRS to claim a REFUND.
For the 'EXPLANATION' section, I sourced it from ustaxgurus.com
The set of documents that you need to mail to the IRS to get a FICA tax refund are:
1) Form 843
2) Form 8316
3) W-2 copy
4) I-94
5) VISA copy
6) DS-2019 (For J-1 Visa)
I-20 (For F-1 Visa)
7) Form I-766 (If you had an OPT)
8) Statement from employer indicating amount of reimbursement your employer provided and if you authorized them to claim refund on your behalf.
CHECK out the IRS PUBLICATION 519 (2022), CHAPTER 8 PAGE 43 to see the set of documents needed to be mailed in detail.
The address for sending these documents is DIFFERENT from the FEDERAL and STATE TAX mailing address. The address is:
DEPARTMENT OF THE TREASURY, INTERNAL REVENUE SERVICE CENTER, OGDEN, UT 83201-0038
