In this Constitutional Law Matters video, Mark Elliott considers the Miller II case, in which the UK Supreme Court held that Parliament had been unlawfully 'prorogued', or suspended, in autumn 2019 during a critical phase of the Brexit process. Professor Elliott explains why the Court reached this conclusion, examines the reliance placed by the Court on the fundamental principles of parliamentary sovereignty and accountability, and considers why Miller II is considered by some to be a controversial constitutional case.
