In this January 16, 2026 pretrial hearing in Provo, Utah, Robinson’s attorneys are asking the judge to disqualify (remove) the entire Utah County Attorney’s Office from prosecuting the case — arguing a serious conflict of interest. The controversy centers on a deputy county attorney’s family member who was reportedly present at the Utah Valley University event when conservative activist Charlie Kirk was fatally shot, and allegedly texted the prosecutor in the immediate aftermath.

The defense claims this personal connection could influence prosecutorial decision-making, create due process concerns, and may have contributed to what they describe as an “emotional reaction” — including the rapid push for the death penalty. Prosecutors strongly deny wrongdoing, arguing the family member did not witness the shooting, has no direct line-of-sight to the gunman, and will not be called as a witness. They say no legal or ethical conflict exists and the office followed proper procedures.

Robinson, 22, is charged with aggravated murder (capital offense) along with additional counts. Authorities allege Kirk was killed by a single shot fired from a rooftop at long distance.
