Welcome to Tuesday’s Tips! Today I want to talk to you about how long you will have to pay spousal support. This will depend heavily upon the length of the marriage. For parties who have a marriage of less than 10 years, that is presumptively what we call a short-term marriage. With most short-term marriages, there will be a set end date for spousal support to allow the supported party to become self-supporting. That is usually approximately half the length of the marriage.
For parties who are married for 10 years or longer, there is a presumption that this is a long-term marriage. In most cases, there will not be a definitive end date for spousal support other than the death of one of the parties or the remarriage of the supported party. When determining how long you will pay spousal support for a long-term marriage, many factors will be considered by the court, including the income of both parties, their ability to be self-supporting, and their ability to maintain the marital standard of living.
When your situation changes, most orders from the court are modifiable to reflect those changes in circumstances. For example, if you are retiring, getting out of the military, or there is some other change to your income, that may be grounds to modify spousal support.
