Can’t find an heir or beneficiary? What happens when you cannot find a missing heir? If an Heir of an estate cannot be found , that heir is considered in a "Missing Heir." And when there is a Missing Heir or Beneficiary the probate settlement proceedings will inevitably be delayed. The administrator or executor of a decedent's estate must by law use "Reasonable Efforts" and "due diligence" in order to find any Missing Heirs or Beneficiaries.
Once the personal representative has demonstrated to the court that "all reasonable efforts have been made to find Missing Heir, and that Missing Heir maybe deceased, the court may allow the personal representative to close the probate administration and distribute proceeds to known heirs or beneficiaries.
The missing heir's inheritance is held in a trust account by the State for a particular period of time then the states looks for the next in Line based on the law of "Intestate Succession." In the case of beneficiaries the Will controls what going to happen with the beneficiary's inheritance. If the Missing Heir has no "next of kin" the unclaimed assets will Escheat to the state, in other the state get control of the assets.
