This video is about whether the police have to testify in your DMV DWI administrative (license) refusal hearing. Not every Court proceeding requires the police to come testify in person.
A driver's license is NOT a legal right.
A driver's license does NOT have the same safeguards as a right.
A driver's license can be lost (suspended or revoked) with minimal proof.
In DMV administrative hearings Hearsay (out of court) statements are allowed. They are permitted to be made and admissible into evidence.
In a DMV DWI refusal hearing finding will be made by an ALJ (administrative law judge). This judge will allow into evidence the police paperwork, police reports, and UTTs (uniform traffic tickets).
This is different than a criminal proceeding where hearsay rules apply and these reports are not allowed into evidence without exception.
