RECKLESS ENDANGERMENT
Colorado law defines reckless endangerment as any conduct which creates a substantial risk of serious bodily injury to another person. Five scenarios which could get someone charged with reckless endangerment under C.R.S. 18-3-208 include:
1. Speed racing on a public street;
2. Driving on a public street with a car that you know has brake trouble;
3. Setting off fireworks in close proximity to another person;
4. Leaving a child alone in a car during a heat wave.
5. Going hunting or target shooting while intoxicated.
Even if no one gets injured from this conduct, the defendant faces a class 2 misdemeanor charge carrying up to $750 in fines and/or up to 120 days in jail.
Possible defenses to reckless endangerment charges include:
1. The defendant’s conduct was accidental;
2. There was no risk of serious bodily injury from the conduct; or
3. The defendant was not aware that the conduct was creating a risk, and a reasonable person would not have been aware of the risk either.
