Should I stay out of work to help my Workers Compensation case?
As a typical attorney I'll always say "it depends". In reality, in New York workers compensation I want you to get back to work as soon as possible, as soon as you are physically and mentally able. Staying out of work in New York doesn't necessarily (and usually doesn't) improve your case.
So here's what I tell people--returning to work is the actual goal of workers compensation: to get you quick medical benefits, get you some money while you're at work, and depending on the type of injury, maybe even some additional money at the end of the case.
Therefore don't just stay out of work because nobody's told you to go back. When you feel that you are ready and able to return to work I want you to do so, because it's only going to help you help me and help your case.
