Peter Selzer sued Marvin Lumber & Cedar Company because the windows he bought from them decayed. Selzer claimed that Marvin breached a warranty, but the court found that Selzer's warranty claims were time-barred and that the economic loss doctrine barred his misrepresentation claims. Selzer made a prima facie showing that an express warranty existed, but the court found that it did not explicitly extend to future performance. Selzer's implied warranty claim was also time-barred. The court dismissed Selzer's false advertising claim as time-barred. Selzer's misrepresentation claims were barred by the economic loss doctrine because the windows were an integral part of an integrated system, and therefore, not subject to misrepresentation claims.
