The coalition government has confirmed it will forge ahead with changes to the Marine and Coastal Area Act, despite the Supreme Court recently upholding the law’s original high threshold for granting customary marine title. The move comes in response to a 2023 Court of Appeal ruling that was seen by some as lowering the bar — even though that ruling was later effectively overturned.
The government says the law must clearly reflect Parliament’s intent and ensure a high test for claims. Critics say the law already strikes the right balance and warn the move undermines the courts. Political correspondent Zane Small explains what’s changing, why it matters, and what it means for the more than 200 Māori claims already in the pipeline.
