Hello this is attorney Brian Pendergraft with The Pendergraft Firm. And for today’s video in my Ask Attorney P. Series I was asked how much does it cost to hire a probate attorney. There are four general pricing structures that I’ve seen in attorneys charge probate cases. They are:
1. Flat rate
2. Percentage based on size of estate
3. Hourly
4. Hybrid Flat Rate + Hourly
Now for an explanation of each starting with flat rate:
Flat Rate - Flat rate fees are in vogue now. More and more attorneys are doing it. I’ve seen rates anywhere from $1k to $10k depending on the difficulty of the case. I’ve personally used this model in the past before. Clients like this model because they know how much things will cost upfront.
Percentage based on size of estate - In many jurisdictions, attorneys are allowed to charge a percentage based on the size of the estate. For example, where I practice law in Maryland attorneys can charge 9% of the first 20k and 3.6% of the amounts higher than 20k. Each State law is different.
Hourly - Some more old school attorneys just like to work to work with an hourly rate. I’ve seen attorneys charge between $250 - $400 an hour when performing “lawyer tasks” and $50 - $100 that when performing “administrative tasks.”
Hybrid Flat Rate + Hourly - Lawyers that use this model tend to charge a high upfront flat fee to take on the case and perform ongoing services at a lower hourly rate. If I was to ever take on another probate case this is the model I would personally follow. :)
There may be fee and pricing structures that I haven’t covered here. Each attorney prices things differently. I recommend talking to a number of attorneys so you can compare and contracts their pricing structures and decide on the one that you are most comfortable with. Also keep in mind that more experienced attorneys may charge more. The more experienced I get the more I raise my own prices.
