Section 240(1) of the New York State Labor law imposes almost strict liability for injuries upon the general contractor and owners of qualified properties sustained by material hoisted or material that should be secured which falls upon a worker.
This provision of law prohibits any claims of comparative fault on the part of the injured worker, and in the event of material falling upon a worker and a violation demonstrated, the case is often won as to 100 percent liability on a paper application known as a Summary Judgment motion before a jury trial.
