On December 11, 2023, Special Counsel Jack Smith filed a petition for a writ of certiorari to the United States Supreme Court, asking that the court immediately take up the question of whether a former President is immune from prosecution for charges of crimes committed while in office. This is in response to Donald Trump's appeals to the 11th Circuit in his Washington, D.C. criminal case, which would potentially take many months to resolve and delay the beginning of Trump's trial.
A writ of certiorari, which is what Smith is requesting with this petition, is how the Supreme Court indicates that a case will be heard.
