Second marriage without the permission of the first wife is a highly sensitive issue in Pakistan. Many people believe that a Muslim man can freely contract a second marriage without any legal consequences. However, Pakistani law clearly regulates polygamy and provides punishment for violation of legal procedure.

The governing law is the Muslim Family Laws Ordinance 1961. Section 6 of this Ordinance clearly states that a married man cannot contract another marriage without prior written permission of the Arbitration Council formed under the local Union Council.
The procedure is as follows:
The husband must submit a written application to the Chairman Union Council.
He must state reasons for the proposed second marriage.
The Union Council forms an Arbitration Council.
The first wife is given notice and opportunity to present her position.
The Council decides whether permission should be granted.
If a man contracts a second marriage without following this legal procedure, he commits a statutory offense.
Legal Consequences:
• Imprisonment (up to one year) • Fine (which may extend to five thousand rupees under the ordinance, though courts may interpret contextually) • Immediate payment of entire prompt dower (Haq Mehr) to first wife • Exposure to maintenance claims • Possible adverse findings in family litigation
Courts in Pakistan, including the Supreme Court of Pakistan, have upheld that while Islam permits polygamy under conditions, the state has authority to regulate the procedure in public interest. Therefore, non-compliance with Section 6 makes the husband legally liable.
