The New Law on Sexual Assault and Rape in Germany

About the lecture
During the last decades, many countries have reformed traditional criminal law on rape and sexual assault that focused on violence and coercion rather than on lack of consent. The German Criminal Code has been changed in 2016, and the German legislature has opted for a “no means no”-model. In my presentation, I will focus on the notion of consent in sexual offence law and describe the outcomes of some newer cases. Furthermore, applying a comparative outlook that includes England, Sweden and Spain, differences will be mentioned with regard to the process of legal reform and the content of criminal prohibitions.

About the speaker
Tatjana Hörnle has been Director at the Max Planck Institute for the Study of Crime, Security and Law in Freiburg and Head of the Department of Criminal Law as well as Honorary Professor at the Humboldt-Universität Berlin since November 2019.

From July 2009 to September 2019, she held the Chair of Criminal Law, Criminal Procedure, Legal Philosophy, and Comparative Law at the Humboldt-Universität Berlin. Before that, from 2004 to 2009, she was full professor for Criminal Law, Criminal Procedure Law and Philosophy of Law at the Ruhr-Universität Bochum.

Tatjana Hörnle is a member of the Leopoldina (National Academy of Sciences), the Berlin-Brandenburg Academy of Sciences and Humanities, the Academy of Sciences and Literature/Mainz, and the Academia Europaea.
