Defendant Charles Lovell transferred his father's farm to himself and his brother through a quitclaim deed, which was not authorized in the power of attorney. Several of the Lovell's children and stepchildren, including the plaintiff, signed a consent statement approving the transfer, but the court found that the transfer was invalid under the amended POA statute. Defendants argued that the power of attorney provision allowed for the power to transfer gifts, despite the lack of explicit language granting such authority.
