Stalking Must be Done Repeatedly Despite a Clear Indication of Disinterest by a Woman:
Bombay HC - Mahadev Narayan Bhusari v. State of Maharashtra
Stalking must be done repeatedly despite a clear indication of disinterest by a woman.
The Bombay HC ruled that,
As per IPC Sec 354-D(1) - Any man who follows a woman and contacts, or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman, commits the offence of stalking
In the present case the sexual intent of the accused towards the woman is proved but if he has made contact with the woman only once, then it will not be considered as an offense under Sec 354-D(1) of IPC.
