On May 11, 2016, OSHA issued a final rule that significantly heightens injury and illness data collection from employers. Not only will many employers electronically submit information about their workplace injuries and illnesses, it will also be posted on OSHA's public website.

OSHA reemphasizes the requirements in the new rule of the whistle blower protections for employees to report injury and illnesses without fear of retaliation.

These changes raise the following questions:
1) Does the employer have a right to drug test after an accident?
2) Will the company's safety incentive plan stop someone from reporting an accident?
