Passenger who disputed ICE’s account of shooting in South Texas dies in car crash

Last Friday, February 20th, The New York Times revealed something the world didn’t know — that 23-year-old Ruben Ray Martinez, a U.S. citizen, was shot and killed by an ICE agent on South Padre Island last March, and that federal authorities had failed to disclose their involvement for nearly a year.
Ruben was accused by ICE of intentionally striking an officer with his car, but there was a passenger who disputed ICE’s account of events.
Ruben’s friend, Joshua Orta, vehemently denied ICE’s reports of that traffic stop. In a statement obtained by The NYT, Joshua said, “Ruben was unarmed, nonviolent, not fleeing and not resisting at the time he was shot. His killing was unjustified and excessive.”
Mr. Orta planned to go public with his testimony and formally refute the government’s narrative. He was preparing to sign his sworn statement and cooperate with further inquiries. In a devastating development, we have now learned that Mr. Orta died in a fiery car crash on a San Antonio highway. Reports say he lost control while driving at high speed and was killed when the vehicle ignited. Joshua’s stepsister, who managed to escape the vehicle before it exploded, suffered severe injuries and remains hospitalized.
Although the timing feels deeply unsettling, the NYT maintains the events are unrelated.
