The Supreme Court of India has delivered two major blows to the Election Commission in a single day during the hearing on the Special Intensive Revision (SIR) of the voter list in West Bengal. Senior advocate Kapil Sibal, appearing for the West Bengal government, presented sharp arguments that forced critical judicial intervention.
The Chief Justice of India, along with Justices Surya Kant, Dipankar Datta, and Jaymala Bagchi, strongly questioned the Election Commission’s handling of so-called “logical discrepancies” affecting nearly 1.25 crore voters. The Court directed the Commission to publicly disclose the complete list of affected voters and display the names at panchayat, block, and election offices, ensuring transparency and the right to information.
In a significant relief for voters, the Supreme Court granted an additional 10 days to individuals whose names were deleted from the voter list, giving them a fair opportunity to respond and verify documents.
The second major setback came when the Court orally made it clear that state board Class 10 admit cards and certificates must be accepted as valid documents for voter verification. This effectively overturned the Election Commission’s earlier refusal to recognize state board certificates, a move that could have disenfranchised large sections of the population.
The Bench also rejected the Election Commission’s logic regarding age gaps between parents and children, stating that Indian social realities such as early marriages cannot be ignored while determining voter eligibility.
Kapil Sibal further highlighted the lack of adequate hearing centres, spelling errors being used as grounds for deletion, and the absence of booth-level support for voters. The Court’s observations underline serious concerns about electoral fairness and administrative accountability.
