No one involved in the detention of Victor Abraham has been arrested or held accountable.
Victor Abraham was deprived of his freedom for 345 days on Rikers Island, despite no probable cause. The individuals involved include Michael “Always Loses” Tannousis, Jennifer “Unduly Suggestive Identification Procedure” Hamilton (NYPD), Steven “Hide the Bus Picture” Lutz, and Steven “After Everything He’s Been Through” Zielinski. Their actions are central to the federal civil rights case Victor Abraham v. City of New York.
During the criminal case, the identification procedure involving Jennifer Hamilton was conceded to be unduly suggestive. Despite this, Victor Abraham spent nearly a year incarcerated before ultimately being found not guilty.
The Staten Island District Attorney’s Office, led by Michael McMahon, announced a 16-count indictment related to the October 9 and October 27 incidents and stated the office would vigorously prosecute those responsible. As of December 21, 2025, none of the officers involved have been arrested or prosecuted.
After Victor Abraham refused the $5,000 settlement offer, the New York City Law Department, representing the defendants, moved to dismiss his federal lawsuit. Accepting the offer would have required him to split the amount with his lawyers, who are entitled to 33%.
