Judge contradicts himself over most severe sex offender conditions for child kidnapper

Описание: A district court judge who had a convicted child kidnapper before his court accused of violating his probation made contradictory statements during subsequent court hearings.

Mark Vincent Devine was the focus of a 2News Investigation which found Summit County Attorney Margaret Olson gave Devine a plea deal and dismissed five felony charges for sexual exploitation of a minor so he could not be required to register as a sex offender because the kidnapping conviction is not a sex offense and is a non-registerable offense.

On the heels of the 2News Investigation, there are severe sanctions and action to protect children against Devine but in the midst of this Third District Court Judge Richard Mrazik seemingly contradicted himself.

Olson previously told 2News Investigates that it was “impossible” to prove this case as an offense that would require him to register as a sex offender. Judge Mrazik was not bound by the prosecution’s plea agreement and could have rejected it. Instead, he accepted it and suspended the prison sentence of one to fifteen years and placed Devine on probation for 48 months under the supervision of Adult Probation and Parole.
