Landlords in the UK face various taxes, depending on their property ownership structure, rental income, and the type of property they own. Here’s a breakdown of the key types:

1. Income Tax on Rental Income
What it covers: All rental income from residential and commercial properties, after deducting allowable expenses.
Rates: Based on the landlord’s income tax band (basic rate of 20%, higher rate of 40%, and additional rate of 45%).
Allowable Expenses: Includes maintenance costs, agent fees, insurance, ground rent, and utilities. Notably, mortgage interest relief has been restricted for residential landlords since April 2020, now replaced by a 20% tax credit on mortgage interest.
2. Capital Gains Tax (CGT) on Property Sales
What it covers: Profit made when a landlord sells a property for more than the purchase price.
Rates: 18% for basic-rate taxpayers and 28% for higher-rate taxpayers, applicable to gains over the annual CGT allowance.
Exemptions/Reliefs: Principal Private Residence (PPR) relief for properties once used as a main home,
3. Stamp Duty Land Tax (SDLT)
What it covers: Paid on the purchase of additional properties.
Rates: An additional 5% (was 3%) SDLT surcharge is applied to the standard rate on second homes or buy-to-let properties in England and Northern Ireland. Scotland and Wales have their own versions—Land and Buildings Transaction Tax (LBTT) and Land Transaction Tax (LTT)—with similar surcharges.
Recent changes: The government periodically adjusts SDLT bands and rates, impacting landlord costs upon purchase.
4. Corporation Tax (for Companies)
What it covers: Applied to rental income and capital gains if properties are owned within a limited company.
Rate: As of April 2023, the corporation tax rate is 25% for profits above £250,000, with a small-profits rate of 19% for profits up to £50,000.
Benefits: Companies are eligible for full mortgage interest relief and may benefit from other allowable deductions, making this structure appealing for some landlords.
5. Inheritance Tax (IHT)
What it covers: Applies to property assets transferred upon death, including rental properties.
Rates: Typically 40% on the value of an estate above the IHT threshold (£325,000, with an additional £175,000 allowance for main residences passed to direct descendants).
Planning Opportunities: Some landlords use trusts or corporate structures to mitigate IHT liabilities.
6. Value Added Tax (VAT) (for commercial properties)
What it covers: VAT applies to commercial property transactions if a landlord opts to tax a property or if development is involved.
Rates: 20% VAT on goods and services, including rent for opted commercial properties.
Residential Properties: Generally exempt from VAT, though VAT may apply to certain services, such as management fees.
7. Non-Resident Landlord Scheme (NRLS)
What it covers: Affects landlords who live abroad but rent out property in the UK.
Operation: UK letting agents or tenants deduct basic-rate tax (20%) from rental income before it’s transferred to the landlord unless the landlord registers with HMRC for gross rent receipts.
8. Annual Tax on Enveloped Dwellings (ATED)
What it covers: Applies to residential properties worth over £500,000 owned by companies or corporate entities.
Rates: Annual charges range from £4,150 to over £269,450 based on property value.
Exemptions: Some properties, such as those rented to third parties or used for business purposes, may qualify for relief or exemption.
