WHAT IS PATENT PENDING...? DOES IT PROTECT YOUR INVENTION...? Answer... Very little at best.

Whether you've filed either a Provisional Patent application or non Provisional application, do not be lulled into a false sense of security, since you have PATENT PENDING STATUS! Your Intellectual Property is far from bullet-proof! Patent Pending does not grant you any meaninful patent protection whatsoever! It's nealy impossible for you to be able to enforce any meaningful patent rights, because the PTO has NOT GRANTED you a Patent yet!
At this point, your application is just in their system, and your claims are only up for consideration!
During the PENDING STAGE, the only thing that you've established is a filing date / priority date.
In short, your priority date gives you the ability to establish what is known as CONSTRUCTIVE NOTICE should someone or some entity begins to produce, market & sell a similar product under one or more of your claims. Your filing date provides a starting point, or what's known as Constructive Notice, a point from which you can establish your intellectual property rights and begin to calculate your potential damages caused by the would-be infriger. All of this Patent Pending status is mute anyway, until such time that some form of your claims has been awarded to you in the form of an official patent grant... and then the fight begins! Bottom line..., don't ever count on being awarded damages or count on striking a licensing agreement with a would-be infringer. Those types of outcomes only happen in fairy tales.

My FLASH OF GENIUS moment came a knockin' when I was in my early twenties, while I was driving tractor trailers over-the-road throughout the United States.
