The 2026 Nationwide Permits take effect March 15, 2026. If you work with Section 404 permits, here is a quick breakdown of what actually changed and what stayed the same.
In this video, Scott Jecker walks through the full reissuance of the Nationwide Permits from the US Army Corps of Engineers, including which permits were modified, which were added and removed, and the two general condition changes you should be aware of.
THE SHORT VERSION:
56 nationwide permits were reissued. Only 15 had any changes, and most were minor. No changes were made to the definitions. Your permitting process should not need significant adjustments.
WHAT CHANGED:
15 of 56 permits had modifications, mostly minor advisory language related to NOAA, Coast Guard coordination, and nature-based solutions
One permit removed: fin fish mariculture
One permit added: fish and aquatic organism passage
General Condition 28 (use of multiple nationwide permits) was updated
General Condition 30 (compliance certification) had a minor verbiage change
PERMITS TO READ CLOSELY:
If you regularly work with Nationwide Permits 27, 45, or 54, review the updated details. The changes are not dramatic, but they are worth understanding for your specific permitting workflow.
